Waiver

By booking, enrolling, attending, or allowing a child to participate in any class, programme, event, open gym, trial session, or activity at Xpressions, you agree to the terms below.

1) This waiver applies to:

  • All participants and visitors on-site, and
  • Parents/guardians consenting on behalf of a child (ages 2–18)
If you are completing a booking for a child, you confirm you are their parent or legal guardian (or otherwise authorised to consent).

2) Acknowledgement of inherent risks

You understand that gymnastics involves inherent risks of injury, including (but not limited to):
  • Falls from or around apparatus (bars, beam, vault, rings, climbing frames, trampolines, mini-tramp, foam pit, mats and landing areas)
  • Mis-timed skills, awkward landings, sprains/strains, fractures, dislocations, bruising and cuts
  • Head impacts including concussion symptoms
  • Collisions with other participants, coaches, equipment, mats, walls or flooring
  • Risks related to foam pits and trampolines (including poor entries, double-bounce, and falling off/onto surrounding areas)
  • Risks arising from behaviour common with children (running, distraction, fatigue, not following instructions)
Serious injury is possible, including (rarely) serious head/neck injury.

3) Safety rules and participation conditions

You/your child agree to:
  • Follow coach instructions and Centre rules at all times
  • Use equipment only as instructed and only in designated areas
  • Not enter restricted areas or attempt skills beyond current ability
  • Behave safely (no running/rough play unless instructed as part of a supervised activity)
The Centre may refuse participation or remove a participant from an activity if behaviour or safety compliance is not acceptable.

4) Supervision, drop-off and pick-up

Coaching supervision is provided during scheduled session times only.
Parents/guardians are responsible for:
  • Safe drop-off and prompt pick-up, and
  • Ensuring children do not wander into training areas unless authorised and supervised.

5) Medical information and emergencies

You agree to inform the Centre of any relevant medical conditions (e.g., asthma, allergies, seizures, injuries) and to update changes.

If a participant is injured or unwell, you authorise the Centre to:
  • Provide basic first aid,
  • Contact the listed emergency contact/parent/guardian, and
  • Call emergency services (111) if required.
If you cannot be reached, you authorise the Centre to arrange reasonable medical assessment/treatment if urgently required.

You are responsible for any costs not covered by ACC/insurance (as applicable).

6) Assumption of risk & limitation of liability

You accept the inherent risks described above and agree that participation is voluntary.

To the extent permitted by New Zealand law, you agree that the Centre and its staff will not be liable for injury, loss, or damage arising from participation where the Centre has taken reasonable care and is not negligent.

Nothing in this waiver is intended to exclude any rights or remedies that cannot legally be excluded (including under the Consumer Guarantees Act 1993 where applicable).

7) Personal property

Participants and visitors bring personal property at their own risk. The Centre is not responsible for loss or theft of personal items.
